MyBookBuddy.ai, a Vanedlay Technologies LLC product, allows users to create personalized coloring books by uploading character photos and providing story prompts. Our service uses artificial intelligence technology to generate custom coloring book pages featuring the uploaded characters.

Key Service Features:

• Upload up to 5 character photos per session
• Generate 3-page previews (free)
• Create full 20-page coloring books pdfs ($4.99)
• Maximum 3 regeneration attempts per session
• Print-on-demand fulfillment option

2. Eligibility and Age Requirements

• You must be at least 18 years old to use our Service
• Our Service operates as a "mixed audience" platform where adults create content for children
• If you upload photos containing children, you must have parental consent for those children
• By using our Service, you represent that you meet these age requirements and have all necessary permissions

3. How You Can Use Our Service

Permitted Uses:

• Create personalized coloring books for personal, non-commercial use
• Upload photos of people you have permission to use
• Generate content appropriate for children ages 3-5
• Order physical printed books through our fulfillment partners

You may NOT:

• Upload inappropriate, offensive, or harmful content
• Upload photos without proper rights or permissions
• Attempt to create inappropriate, offensive, or harmful content
• Use our Service for commercial purposes without written consent
• Attempt to reverse engineer or copy our technology
• Violate any applicable laws or regulations
• Violate the intellectual property rights or copy right of another in the content you generate
• Upload content that infringes others' intellectual property rights
• Use our Service to create content that could harm children

4. AI-Generated Content and Accuracy

You understand and agree that:

• AI-generated content may not always be accurate or appropriate
• Generated images may not perfectly represent uploaded characters
• You should review all generated content before use
• AI technology is probabilistic and results may vary
• We cannot guarantee specific outcomes or quality levels
• Generated content should not be relied upon as factually accurate

Content Review: You are responsible for reviewing all generated content to ensure it meets your expectations and is appropriate for your intended use.

5. Your Content and Our Content

Your Uploaded Content

• You retain ownership of photos and text you upload ("Your Content")
• You must be 18+ and have all necessary rights to upload and use Your Content
• COPPA Compliance: You confirm you have parental consent for any children shown in uploaded photos
• You grant us a limited license to use Your Content solely to provide our Service during your session

Generated Content

• You own the AI-generated coloring book pages we create for you
• We assign to you all our rights in the generated output
• Other users may receive similar output due to AI technology limitations
• Our ownership assignment doesn't extend to other users' content

Our Use of Content

We may use Your Content and generated content to:

• Provide, maintain, and improve our Service
• Comply with legal requirements
• Enforce these Terms
• Keep our Service safe and appropriate

6. Session Limits and Usage Restrictions

Each session includes:

• Maximum 5 character uploads
• Maximum 3 regeneration attempts
• Session expires after period of inactivity

These limits help us manage costs and ensure fair access for all users.

7. Payment and Pricing

• Full pdf coloring book (20 pages): $4.99
• Payment processed securely through third-party providers
• All sales are final - no refunds except as required by law
• Additional fees may apply for shipping

8. Print Fulfillment

We partner with third-party print providers to fulfill physical book orders:

• Print quality and delivery are handled by our fulfillment partners
• Shipping times and costs determined by fulfillment provider
• We are not responsible for print quality, shipping delays, or delivery issues
• Address any print or shipping concerns directly with the fulfillment provider

9. Intellectual Property

Respect for Others' Rights

• Only upload photos you have permission to use
• Respect copyright, trademark, and privacy rights
• Do not upload photos of people without their consent

Our Intellectual Property

• Our Service, technology, and branding are protected by intellectual property laws
• You may not copy, modify, or distribute our proprietary technology
• Our name and logo may only be used as permitted by our brand guidelines

10. Third-Party Services

12. Service Availability and Changes

• We do not guarantee uninterrupted service availability

13. Disclaimers and Limitation of Liability

YOU UNDERSTAND THAT:

LIMITATION OF LIABILITY:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VANDELAY TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

14. Indemnification

You agree to indemnify and hold harmless Vandelay Technologies LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your uploaded content
• Your violation of these Terms
• Your violation of any third-party rights

15. Termination

You may stop using our Service at any time.

We may terminate or suspend your access if:

• You upload inappropriate content
• Required by law
• Your use poses risks to our Service or other users

16. Dispute Resolution

Governing Law: These Terms are governed by Washington law, without regard to conflict of law principles.

Informal Resolution: Before formal legal action, we encourage you to contact us at legal@vandelaytech.com to resolve disputes informally.

Arbitration: Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Delaware. You waive any right to a jury trial or class action.

Exceptions: Either party may seek injunctive relief in court for intellectual property violations or urgent safety matters.

17. General Terms

• Entire Agreement: These Terms constitute the entire agreement between you and Vandelay Technologies LLC regarding our Service
• Severability: If any provision is found unenforceable, the remaining provisions continue in effect
• No Waiver: Our failure to enforce any provision doesn't waive our right to do so later
• Assignment: You may not assign these Terms. We may assign our rights to any affiliate or successor
• Updates: We may update these Terms with 30 days' notice for material changes. Continued use constitutes acceptance
